This policy explains what personal information TERMINAL, a DBA of 20/20 Studio LLC (“TERMINAL”, “we”, “us”, or “our”) collects through terminalagency.com and its subdomains (the “Website”) and through our software, including Preflight, Dispatch, and Load Sheet (the “Software”), and how we use it. We are the controller of this information, except where we say another company is responsible for it.
Information we collect
When you contact us. If you email us or use a form on the Website, we receive your name, email address, company, and anything you include in your message.
When you buy software. Payments are handled by our reseller, Paddle.com, which is the Merchant of Record for our orders. Paddle collects your payment details directly; we never see or store your full card number. Paddle shares with us your name, email address, country, postal or ZIP code where collected, company name and tax number if you provide them, and the details of your order.
When you activate and use Paid Software. To issue and enforce licenses, our licensing service records:
- your License Key and the email address it belongs to;
- a random identifier that Preflight creates once on each computer, plus the computer’s name so you can tell your Machines apart in your account;
- whether the computer runs Windows or macOS, and the version of Preflight it is running;
- the date and time of each activation, release, and license check-in. Cloudflare, which runs the licensing service, also receives your IP address with each request.
The Software does not send the contents of your SketchUp models, drawings, or other files to us.
When you confirm your email in the free version. To unlock your free full cleanup, we record the email address you confirm, the identifier of the Machine that asked for it, and when the confirmation link was sent, confirmed, and used. The free cleanup is limited to one per email address, confirmed by a link we email to that address, and a Machine that has already had a free cleanup under one address cannot get another under a different address.
When you use your customer account. We record each sign-in, each time you reveal your License Key, and each Machine you activate or release, with the date, time, and IP address. We also send you sign-in and license emails.
When you download software. We log the date, time, IP address, and file of each download to keep downloads secure and understand demand.
When you browse the Website. Our hosting and security providers automatically receive technical information such as your IP address, browser type, pages requested, and the referring page. The Website uses cookies that are necessary for it to work and stay secure. We use Cloudflare Web Analytics to count visits. It records the page viewed, the referring site, browser and device type, and approximate country, without cookies or cross-site tracking, and it does not identify individual visitors. We also use Google Analytics to understand how visitors use the Website. It sets cookies and records the pages viewed, the referring site, browser and device type, approximate location, and how long each visit lasts. We use it only to measure the Website, not for advertising, and Google signals and ad personalization are turned off. If you are in the EEA, the United Kingdom, or Switzerland, Google Analytics runs only if you accept cookies, and you can change your choice at any time with the Cookie settings link at the bottom of each page. Anyone can also block these cookies in their browser settings. We do not use advertising or cross-site tracking cookies.
How we use your information
We use personal information to:
- deliver your purchase, including sending your License Key and receipts;
- activate licenses, enforce Machine limits and offline allowances, and let you release Machines;
- provide downloads, updates, beta access, and support;
- reply to inquiries and discuss projects with you;
- send service emails about your license, such as security notices and important product changes;
- prevent fraud, license sharing, and other abuse, and keep the Website and Software secure; and
- meet our legal, tax, and accounting obligations.
We only send marketing emails, such as news about new products, if you have opted in, and every marketing email includes a way to unsubscribe.
Legal bases (EEA and UK users)
If you are in the European Economic Area or the United Kingdom, we rely on these legal bases: contract, to deliver and license the software you buy and to provide your account; legitimate interests, to secure our services, prevent license abuse, respond to inquiries, measure visits to the Website, and improve our products; consent, for marketing emails and any non-essential cookies, which you can withdraw at any time; and legal obligation, to keep records we are required to keep.
Who we share it with
We do not sell your personal information and we do not share it for cross-context behavioral advertising. We share it only with service providers who help us run our business, under contracts that limit their use of it:
- Paddle, our reseller and Merchant of Record, for payments, tax, invoicing, and refunds. Paddle is an independent controller of the information it collects at checkout; see Paddle’s privacy policy.
- Cloudflare, which hosts our licensing service, customer account, and downloads, protects the Website, and measures visits to it.
- Google, which provides Google Analytics. See Google’s privacy policy.
- Webflow, which hosts the Website and its forms.
- Resend, which sends our license and account emails.
- Our email and office software providers, for correspondence.
We may also disclose information if the law requires it, to protect our rights or the safety of others, or to a buyer or successor as part of a merger, acquisition, or sale of our business.
International transfers
We are based in the United States, and our service providers may process information in the United States and other countries. Where we transfer personal information from the EEA, UK, or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses or our providers’ certification under the EU-U.S. Data Privacy Framework.
How long we keep it
- License, order, and activation records: for as long as your license exists, because your license is perpetual and you may reinstall at any time. If you ask us to delete your account, we will delete these records, which will deactivate your license. If your license is refunded or canceled, we delete its records two years after it was last active.
- Tax and accounting records: for as long as the law requires, usually seven years.
- Inquiries and project correspondence: up to three years after our last contact, unless we are working together.
- Free-version email confirmations: if the free cleanup is never used, we delete the request two years after it was last active. Once it has been used, we keep it for as long as we need to limit the free cleanup to one per email address, or until you ask us to delete it.
- Download and server logs: up to 12 months.
- Google Analytics data: 14 months.
Your rights
Depending on where you live, you may have the right to access the personal information we hold about you, correct it, delete it, receive a copy in a portable format, object to or restrict certain processing, and withdraw consent. California residents have the right to know what we collect and why, to delete and correct it, and not to be discriminated against for exercising these rights; we do not sell or share personal information as those terms are defined under California law.
To make a request, email contact@terminalagency.com. We may need to verify your identity first, and we will respond within the time the law allows. You may also complain to your local data protection authority.
Security
We protect personal information with measures such as encryption in transit, access controls, and limiting access to people who need it. No system is completely secure, so please keep your License Key and account email safe and tell us if you think they have been compromised.
Children
The Website and Software are intended for professionals and are not directed at children under 16. We do not knowingly collect information from children.
Changes to this policy
We may update this policy from time to time. We will post the new version here with a new “Last updated” date and, if the changes are significant, tell license holders by email.
